Insurance Fraud Charges – California Penal Code Section 1871

If someone has committed insurance fraud, it is defined as someone who has provided false information to their insurance or anotherÂ’s insurance company for the benefit of services, money or other items to which they are not legally entitled. Making false statements such as vehicles being stolen or claiming that property was damaged when it wasnÂ’t, can be defined as insurance fraud. There are several examples which fall under the umbrella of insurance fraud and the defendant can be charged with either a misdemeanor or a felony. Charges can include jail or prison time, restitution, large fines, etc.


Jail Release Process

ItÂ’s important to know that it can take anywhere from 2 to 6 hours to book (process, photograph and fingerprint) an inmate into jail. Bail cannot be posted until they have been completely booked and entered into the system. When you bail someone out of jail it can also take a few of hours, depending upon their individual circumstances, the size of the jail and the staff on hand. You should know that if they do not make bail while in jail, they will be held until their first arraignment. Jail staff may not be able to let us know when an arrestee will be released, but once released; they will have access to a phone. Bail bond fees are regulated by the Department of Insurance. A bail bond in California costs 10% of the total bail amount. That means if the bail amount is $25,000 it will cost a non-refundable fee of $2,500 to bail an inmate out of jail.
